1. Acceptance of Terms

By downloading, installing, or using the mobile application (the "Application" or "Game") provided by Lightwell Games, LTD. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use or access the Application. These Terms apply to all users of the Game.

2. Apple App Store Specific Terms

If you download the Application from the Apple App Store, the following additional terms apply:

Acknowledgment: You acknowledge that these Terms are concluded between you and Lightwell Games, LTD. only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the Application and its content.
Maintenance and Support: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
Warranty: To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.
Product Claims: We, not Apple, are responsible for addressing any claims by you relating to the Application or your possession and/or use of the Application.
Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

3. In-App Purchases (IAP) and Virtual Goods

The Application may include virtual currencies, coins, items, or services for use within the Game ("Virtual Goods").

Purchases: You may purchase Virtual Goods through the Apple App Store using real money. All payments are processed by Apple. Lightwell Games, LTD. does not process your credit card or payment information.
No Real-World Value: Virtual Goods have no monetary value and cannot be redeemed for real money, goods, or services from us or anyone else. You do not own the Virtual Goods; instead, you receive a limited, personal, non-transferable, and revocable license to use them in the Game.
Refunds: All sales of Virtual Goods are final. Because payments are handled by Apple, any refund requests must be directed to Apple Customer Support in accordance with Apple’s policies. We cannot grant refunds directly.

4. User Conduct and Restrictions

You agree not to use the Application in any way that:

Violates any applicable law or regulation.
Attempts to hack, modify, decompile, reverse engineer, or exploit the Application or its servers.
Uses cheats, exploits, automation software (bots), hacks, or any unauthorized third-party software designed to modify or interfere with the Game experience.
Interferes with other users' enjoyment of the Game. We reserve the right to suspend or terminate your access to the Application if we determine, in our sole discretion, that you have violated these rules.

5. Intellectual Property Rights

All rights, title, and interest in and to the Application, including but not limited to its graphics, design, text, animations, music, code, and "look and feel," are the exclusive property of Lightwell Games, LTD. or its licensors. You may not copy, distribute, or create derivative works from the Application without our prior written consent.

6. Third-Party Services and Ads

The Application is ad-supported and utilizes third-party advertising networks and analytics tools (e.g., AdMob, AppLovin, Unity, Facebook). These services may collect data to provide targeted advertisements and improve game performance. Your use of the Application is also governed by our Privacy Policy, which details how we and our partners collect and use your data.

7. Age Restrictions

The Application is not intended for children under the age of 13. By using the Application, you represent and warrant that you are at least 13 years of age. If you are between the ages of 13 and the age of legal majority in your jurisdiction, your parent or legal guardian must review and agree to these Terms on your behalf.

8. Disclaimer of Warranties

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LIGHTWELL GAMES, LTD. EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LIGHTWELL GAMES, LTD. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APPLICATION; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APPLICATION.

10. Termination

We reserve the right to terminate or suspend your access to the Application at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Application will immediately cease.

11. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms within the Application or on our website. Your continued use of the Application after any such changes constitutes your acceptance of the new Terms.
